How to Choose an Attorney for Your Divorce

HOW TO CHOOSE AN ATTORNEY – 5 TIPS

Most people who want to use an attorney need them to provide guidance and protection during the divorce. And naturally, you want the most effective attorney for the least amount of money!

I’m guessing that if you are reading this article, you are considering hiring an attorney. In most cases it is WISE to at least get some consultation time with an attorney. I agree that having attorneys battle each other is expensive and conflict-generating. But in most cases, not consulting with an attorney at all is like not seeking medical attention for a painful illness. Beware of choosing an attorney merely from an ad, because they offered you a free consultation, or because your Aunt Mary used the same one. It makes sense to get some professional guidance in choosing an attorney, as well as doing a deep assessment yourself.

Here are the 5 top areas to assess as you look for the right attorney for you:

1) Is the attorney a “peaceful warrior?” You want an attorney who will negotiate whenever possible… but fight for you if necessary. How often does the attorney settle his/her cases? How skillfully and assertively will the attorney negotiate on your behalf? How effective are the courtroom skills of the attorney?

2) How do you feel with the attorney? Is there a good rapport between you? Is the attorney open to hearing your concerns and goals? Or do you feel intimidated by the attorney? Does the gender of the attorney make a difference to you? How much emotional support do you expect from your attorney? Note: you don’t only rely on the attorney’s “bedside manner,” so read on.

3) How experienced and knowledgeable is the attorney? Does he or she need to have some expertise in a particular area that’s important to your case, such as business valuation, domestic violent, disability, children’s issues, etc.? Do the fees seem in line with the attorney’s level of expertise?

4) How busy is the attorney? Is the attorney overloaded right now? How soon can he/she get to your case? Does the attorney file their paperwork on time? Is the attorney well organized? How long does the attorney take to return your important calls?

5) How does the attorney match the skills of your spouse’s attorney? You don’t want your lamb in the ring with your spouse’s lion. You may not need a lion to deal with your spouse’s lamb. Can the two attorneys communicate well with each other, or is there conflict between them that will increase your fees?
